1. Acceptance of Terms

The Pokeodds.com website at https://pokeodds.com, along with all related downloads, software, avatars, content, and services (collectively, the “Site”), is operated by Pokeodds. These Terms & Conditions (the “Agreement”) govern all use of and access to the Site.

Please review this Agreement together with the Pokeodds Privacy Policy (“Privacy Policy”). BY ACCESSING OR USING THE SITE, YOU CONFIRM THAT YOU MEET ALL ELIGIBILITY REQUIREMENTS AND AGREE TO BE BOUND BY THIS AGREEMENT. This Agreement forms a binding contract between you (“you” or “User”) and Pokeodds and applies to all tools, products, services, and other materials (“Content”) available on or through the Site.

2. Packs and Associated Initiatives

2.1 Virtual Packs and Tangible Cards

Our platform permits the acquisition of enclosed virtual trading card bundles or sets, known as "Digital Packs." Every Digital Pack is linked to actual cards that are safely warehoused, termed "Physical Cards." These elements combined form the "Items." By securing a Digital Pack, you receive from Pokeodds a limited, cancellable, non-sharable, non-assignable, and non-licensable right to access, unpack, and showcase it via the platform purely for individual amusement and organizing your collection. Ownership of all copyrights, brand marks, and visual elements in the cards stays with the original proprietors.

2.2 Claiming Physical Versions

If offered, you can claim the tangible cards tied to your Digital Pack through the outlined claiming procedure, along with settling any relevant costs for delivery, packaging, or protection. Title to the Physical Cards passes to you solely at the point of handover to the shipping provider.

2.3 Trade-In for Platform Currency

In line with Pokeodds's existing Trade-In Policies, eligible Items can be turned in to Pokeodds for credits usable only on the site, which cannot be cashed out. The amounts credited, qualification standards, and turnaround periods are decided entirely by Pokeodds and could be altered without notice.

3. Scope of License

3.1 Site License

Provided you comply with this Agreement and all posted Site policies, Pokeodds grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to use the Site on mobile, tablet, or desktop devices for the purpose of purchasing, opening, viewing, redeeming, trading, or selling back Items through the tools we provide. Any other use—including data scraping, commercial exploitation, or reverse engineering—is prohibited.

3.2 Digital-Item License

Digital Packs and their digital card reveals are licensed—not sold. You receive a personal, revocable, non-transferable, and non-sublicensable license to display and manage the digital representation of the underlying Physical Cards on the Site. No ownership or IP rights are transferred.

3.3 Avatars and Other User Assets

Avatars or similar on-Site graphics offered by Pokeodds are licensed under the same limited terms and may not be sold, transferred, sublicensed, or commercially exploited.

3.4 Prohibited Transfers

Any attempt to sell, transfer, or assign your Account, Digital Pack license, or Site credits is void and constitutes a material breach of this Agreement.

3.5 Service Modifications

Pokeodds may modify, suspend, or discontinue any part of the Site—features, Items, or content—at any time without notice. If a Digital Pack or feature is discontinued, the associated license automatically terminates. Pokeodds is not liable for such changes except where required by law.

4. Restrictions on Use of the Site

To maintain the safety and integrity of the Site, you agree not to engage in any of the following prohibited activities (“Prohibited Activities”):

Misconduct Toward Others

• Threatening, harassing, stalking, or bullying Users, staff, or customer-support representatives.
• Using profanity, hate speech, or discriminatory language in usernames or Site communications.
• Impersonating another individual or entity or misrepresenting your affiliation.

Misuse of Site Content or IP

• Uploading or sharing content that infringes intellectual property, privacy, or publicity rights, or that contains viruses or malicious code.
• Downloading, copying, or distributing Site images, card scans, or other Pokeodds content outside the Site unless explicitly permitted.
• Using Pokeodds or third-party trademarks, logos, or meta tags without written authorization.

Technological Abuse

• Scraping, crawling, mining, or otherwise extracting Site data through automated tools.
• Attempting to bypass or interfere with security features or probing system vulnerabilities.
• Reverse engineering, decompiling, or exploiting software bugs or unintended Site behaviors. Any discovered issue must be reported immediately to Support.

5. Enforcement

Pokeodds may determine, at its sole discretion, whether your behavior violates the Prohibited Activities or otherwise misuses the Site. Available actions may include account suspension or termination, cancellation of pending orders, forfeiture of spins, referral to authorities, or other protective measures. If your account remains restricted for twelve (12) consecutive months, Pokeodds may permanently delete all associated Items, credits, and content without additional notice.

6. Creating and Maintaining an Account

6.1 Eligibility and Registration

To buy, open, redeem, resell, or otherwise interact with Items on the Site, you must create a unique Pokeodds account (“Account”). You may register only one Account. Accounts are personal, non-transferable, and non-assignable. If you choose to sign in via third-party authentication (SSO), you authorize Pokeodds to receive relevant information and acknowledge that those credentials control access to your Account.

8. Deletion of Account Information and Data-Privacy Requests

Erasure or data-deletion requests may be submitted to [email protected] in accordance with our Privacy Policy. Additional verification may be required.

13. Payment, Taxes, and Shipping

Payment processing may be handled by third-party providers. Their terms apply. Taxes and shipping charges will be shown at checkout as applicable.

25. Governing Law

These Terms are governed by the laws described in the full policy available on the Site. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
